Why Insurance Companies Deny Valid Claims
Denials are rarely final — they're often the opening move in a negotiation. Here are the most common denial tactics and how we counter each one.
Policy Exclusion Claim
The insurer argues the damage falls under an exclusion — mold, flood, wear and tear. Often misapplied or contradicted by the actual policy language.
Undervaluation / Low Offer
Not technically a denial — but paying 30 cents on the dollar is the same result. Insurers use in-house estimators who consistently undervalue damages.
Insufficient Documentation
The insurer claims you haven't proven your loss adequately. This is often a delay tactic — but without proper documentation, it sticks.
Late Reporting
Insurers claim you didn't report promptly. Many NY policyholders don't know they have rights even after a delayed report — especially for hidden damage.
Cause of Loss Dispute
The insurer disagrees on what caused the damage — attributing covered storm damage to pre-existing wear, or flood to a covered water event.
Bad Faith Denial
Sometimes an insurer denies a claim knowing it's valid — betting you won't fight back. Bad-faith denials in NY can result in extra-contractual damages.
Two Ways We Fight a Denial
Depending on the reason for your denial, we pursue the most effective strategy — a formal appeal or the binding appraisal process.
Formal Appeal & Claim Re-opening
When your claim is outright denied, we build a documented rebuttal and demand the insurer reconsider. If they refuse, we escalate to the NY Department of Financial Services.
- Detailed review of denial letter and policy
- Independent damage inspection & expert reports
- Written rebuttal submitted to insurer
- DFS complaint filed if insurer doesn't comply
- Negotiation through settlement or litigation referral
Insurance Appraisal Process
When the insurer accepts the claim but disputes the amount, we invoke the appraisal clause in your policy — a binding dispute resolution process that bypasses litigation.
- Invoke appraisal clause in your policy
- We serve as or select your certified appraiser
- Neutral umpire appointed if appraisers disagree
- Panel issues binding award — insurer must pay
- Faster and cheaper than going to court
How the Insurance Appraisal Process Works in NYC
The appraisal clause is one of the most powerful — and underused — tools available to policyholders. Here's exactly how it unfolds.
Don't Miss Your Appraisal Window
Most policies require you to demand appraisal within a specific timeframe after a dispute arises — sometimes as little as 60 days. Waiting too long can waive your right. Contact us the moment you receive a low offer or denial.
Dispute Arises — We Invoke the Appraisal Clause
Once the insurer issues a low offer or partial denial, we send a formal written demand invoking the appraisal provision of your policy. This puts the insurer on notice and starts the clock.
Each Side Appoints a Certified Appraiser
You (through Claimpress) select a competent, independent appraiser. The insurance company selects theirs. Both appraisers must be disclosed within the timeframe specified in the policy — typically 20 days.
A Neutral Umpire Is Appointed
If the two appraisers cannot agree on a value, they jointly select a neutral umpire. If they can't agree on an umpire, either party may petition a court to appoint one. The umpire is the tiebreaker.
Both Appraisers Inspect the Damage Independently
Each appraiser conducts their own inspection and prepares an itemized valuation. Claimpress submits a comprehensive, fully documented damage report backed by contractor estimates and expert assessments.
A Binding Award Is Agreed By Any Two of Three
If any two of the three (your appraiser, their appraiser, or the umpire) agree on the amount, that figure becomes the binding award. The insurer has no option to reject it — they must pay.
Insurer Pays Within the Statutory Deadline
After the award is signed, the insurer must issue payment within the timeframe set by state law — typically 5 business days in New York. We monitor compliance and escalate immediately if they delay.

Insurance companies have teams of trained adjusters and lawyers. You deserve the same firepower on your side.

No Win, No Fee
We work on contingency. You pay nothing upfront and nothing if we don't recover more than the insurer's original offer. Our fee is capped by NY law at 12.5% of the settlement.
NYC-Specific Expertise
From co-op and condo board claims to multi-family buildings and commercial properties — we know NYC's unique insurance landscape, building codes, and contractor market.
NYC Policyholders Who Fought Back
These clients were told their claims were denied or the offer was final. They weren't.
"My insurer denied my water damage claim entirely — said it was 'gradual damage.' Claimpress reviewed my policy, proved it was sudden and accidental, and got me $48,000. I almost gave up."
"The insurance company offered $22,000 for my fire damage. After the appraisal process with Claimpress, the binding award came back at $91,000. I didn't even know appraisal was an option."
"Three months of back-and-forth with my insurance company going nowhere. Claimpress came in, filed the appraisal demand, and had a check in my hands 6 weeks later — for triple the original offer."

Denied Insurance Claim Help in New York City
Receiving a denied insurance claim letter is devastating — especially when you've been paying premiums for years expecting protection. But a denial is not the end of the road. In New York City, policyholders have significant legal rights, including the right to a formal appeal, the right to invoke the appraisal process, and the right to file a complaint with the New York State Department of Financial Services (DFS).
Claimpress® is a licensed public adjusting firm based in Long Island City, Queens, serving property owners across all five boroughs, New Jersey, and Connecticut. Our team has successfully challenged hundreds of denied and underpaid claims — recovering millions of dollars for homeowners, landlords, business owners, and co-op and condo residents who were initially turned away by their insurers.
What Is the Insurance Appraisal Process in New York?
The insurance appraisal process is a binding dispute resolution mechanism built into most standard property insurance policies. When a policyholder and insurer disagree on the value of a covered loss, either party can invoke the appraisal clause, triggering a structured process: each side appoints an appraiser, and if those appraisers disagree, they select a neutral umpire. Any two of the three reaching agreement creates a binding award the insurer must pay.
Most NYC policyholders have never heard of the appraisal process — and insurance companies prefer it that way. It's faster than litigation, less expensive, and historically results in significantly higher payouts for policyholders who are properly represented. At Claimpress, invoking and managing the appraisal process is one of our core specialties.
